Bathing rules
Foreword
The Bathroom Hygiene Act obliges the licensee of a bathing establishment to regulate the conduct to be observed by guests for the protection of their health, in particular in terms of hygiene, within the framework of bathing regulations (Section 13 Para. 2 BHygG).
The Bathing Hygiene Ordinance obliges the owner of a bathing establishment to issue bathing regulations to regulate proper bathing and sauna operations and to display them in a clearly visible place. Bathing regulations must regulate the behavior to be observed by guests of a sauna facility for the protection of health, in particular with regard to hygiene (§ 44 BHyG).
The European standard on safety requirements for the operation of swimming pools also provides a great deal of information for visitors (EN 15288-2).
In order to become part of the contract, bathing regulations must be available to bathers before they buy their admission ticket . They must therefore be clearly displayed in front of the cash desk.
Safety information and regulations (e.g. about water depth), rules for the use of the facility, public information and an orientation plan should be available. Preferably, this information should be presented in the form of graphic symbols.
Bathing regulations
Dear guests! By purchasing an admission ticket, you conclude a bathing contract with LTR Thermenresort Loipersdorf GmbH (hereinafter: “bathing facility”) and thereby recognize the following bathing regulations as legally binding content of the contract.
1. Obligations of the bathing facility
1.1 Granting the use of the facilities, assumption of risk by guests
(1) The bathing facility allows guests to use the facilities of the bathing facility at their own risk within the framework of the regulations of these bathing regulations.
(2) It is not possible for either the bathing facility or the staff to prevent bathing accidents in general. In particular, guests themselves bear the risks associated with practicing the sport practiced on the bathing area .
(3) The same applies to injuries and other intrusions into the personal sphere of bathers by other guests or other third parties who are not members of the bathing facility staff.
(4) The bathing facility only assumes the following obligations towards guests.
1.2 Opening hours and granting of access
(1) The bathing facility is obliged to allow visitors to enter during the opening hours announced on the notice board or by the supervisory staff.
(2) If the officially permitted number of visitors is exceeded, the bathing facility may, with the help of the responsible staff, prohibit the admission of further visitors. In such cases, visitors must expect waiting times.
(3) The bathing facility reserves the right to deny access to persons whose admission to the baths appears questionable without giving reasons.
(4) Animals are not permitted. Exceptions are service dogs of the police and rescue services as well as guide dogs, assistance dogs and partner dogs, insofar as this is necessary for the fulfillment of their tasks.
1.3 Condition and operation of the facilities
(1) The bathing establishment is responsible for ensuring that the facilities are installed, operated and maintained in accordance with regulations. In particular, the bathing facility must comply with all applicable hygiene and safety regulations. The bathing establishment has no further obligations.
(2) As soon as the bathing establishment becomes aware of the malfunction, defectiveness or damage of a facility, which no longer guarantees safe operation, the bathing establishment shall immediately prohibit the use of the malfunctioning facility or restrict its use in an appropriate manner.
(3) Bathers are responsible for complying with the instructions of the responsible staff at.
1.4 Monitoring compliance with the bathing regulations
The bathing facility monitors compliance with the bathing regulations by guests and other persons present on the bathing facility premises as far as is reasonable with the help of its responsible staff. If is found to be in breach of the rules, the persons concerned will be warned and may be expelled from the premises if necessary.
1.5 Assistance in the event of accidents
In the event of an accident, the pool facility staff will immediately initiate assistance measures within reasonable limits. First aid materials are available from the pool attendant if required. The locations of semi-automatic defibrillators are signposted. In the event of an accident, all bathers are required by law to provide first aid until the arrival of qualified emergency services. Accidents must always be reported to the pool staff.
1.6 Assistance in averting reported dangers
If the bathing facility, in particular the responsible staff, is notified by guests of an imminent danger to the health and life of guests, the bathing facility will make reasonable efforts to avert this danger with the help of its staff.
1.7 No possibility of supervising minors, underage persons, impaired persons and non-swimmers
(1) The operator of the bathing facility and its staff are neither able nor obliged to supervise children, minors, physically and mentally impaired persons and non-swimmers.
(2) Children, minors, non-swimmers and people with disabilities must be supervised by the persons otherwise responsible for these persons (e.g. legal guardians, relatives or appropriate supervisors, carers or caregivers). When using the attraction facilities, the duty of supervision is increased. The duty of supervision shall remain in force even if the person subject to supervision does not enter the premises of the pool operator or leaves the premises prematurely.
(3) The applicable youth protection regulations, in particular bans on alcohol and smoking, bans on staying, obligations of legal guardians, etc. must be observed by the young people and their legal guardians.
(4) Non-swimmers and children up to the age of 10 may only enter the bathing establishment with an accompanying and supervising person. Minors over the age of 10 may only enter the bathing facility with the written permission of a parent or guardian.
1.8 Liability of the bathing facility
(1) The bathing facility is only liable for damage that it or its staff has caused to the bathing guest through unlawful, in particular non-contractual, and culpable behavior. The bathing facility accepts no liability for damage to third parties caused by items brought in by guests.
(2) The bathing facility is not liable for damage caused by disregarding the bathing regulations, any other usage regulations or by disregarding the instructions of the staff, by other own fault of the injured party or by unavoidableevents or force majeure, in particular also by interventions of third parties. Contributory negligence shall lead to a corresponding apportionment of damages. The same applies mutatis mutandis to any special rules of use (e.g. for the slide, diving tower, sauna etc.) displayed at the respective equipment and facilities as well as to any prohibitions or restrictions on use within the meaning of point 1.3.para.2.
(3) The use of parking spaces is at the user's own risk. The bathing facility is not obliged to guard parking spaces at or to maintain its areas and other facilities in order to protect vehicles from damage (e.g. from nails, broken glass or potholes on the areas).
(4) Please do not leave any valuables (cell phone, wallet, etc.) unattended. No liability is accepted in the event of theft or loss.
2. Obligations of the guests
2.1 Admission tickets, keys, data carriers, prepaid cards; fees
(1) Use of the bathing facilities is only permitted with a valid admission ticket according to the price list. The price list is part of the bathing regulations.
(2) Admission tickets must be kept for the entire duration of the visit to the baths. Lost admission tickets will not be reissued. The visitor must leave the baths or purchase a new admission ticket.
(3) A deposit may be required for keys or data carriers issued on the basis of the applicable price list .
(4) Issued keys, data carriers or prepaid cards must be returned when leaving the baths.
(5) Lost keys or data carriers must be replaced.
2.2 Supervision of children, minors, non-swimmers and impaired persons
(1) The persons responsible for the supervision of children, minors, non-swimmers and impaired persons (e.g. relatives with parental authority or appropriate supervisors or carers) must make appropriate provisions for the supervision of these persons. Minors up to the age of 10 must be accompanied by a responsible person
(2) These persons subject to supervision remain responsible for supervision even if they do not enter the premises of the bathing facility or leave prematurely.
(3) The applicable youth protection regulations, in particular bans on alcohol and smoking, bans on staying, obligations of legal guardians, must be observed by the young people and their legal guardians.
2.3 Supervision of group visits
(1) In the case of group visits, the responsible supervisor, in the case of clubs and other organizations the responsible official, must ensure compliance with the bathing regulations and bear full responsibility for this. The relevant supervisors must be present for the entire duration of the group visit.
(2) These supervisors must maintain proper consultation with the supervisory staff of the bathing facility in order to ensure that the other normal bathing operations are not disturbed by the group visit .
2.4 Instructions of the bathing facility staff
(1) Guests are obliged to follow the instructions of the responsible bathing facility staff without restriction. This also applies if a bathing guest is of the opinion that the instruction given to them is not justified. In particular, this extends to all measures taken by the bathing facility in the course of the COVID-19 pandemic.
(2) Anyone who violates the bathing regulations or bans on the use of certain facilities (e.g. slide, diving tower, sauna) or restrictions within the meaning of point 1.3. para. 2 or disobeys the instructions of the responsible staff may be expelled from the baths by the staff or another representative of the bathing facility without any entitlement to a refund of the admission fee.
(3) In special cases, a ban on future visits may also be imposed. In the event of non-compliance, the guest is liable to prosecution for trespassing.
(4) In the event of approaching storms, the outdoor pools must be vacated in good time for safety reasons.
2.5 Hygiene regulations
(1) Bathers are obliged to keep the entire bathing facility extremely clean; a cleaning charge may be levied in the event of wilful soiling. The barefoot area may not be entered with street shoes .
(2) The bathing facility is to be used with normal, hygienically impeccable swimwear (e.g. swimsuit, bikini, swimming trunks, burkini etc.).
(3) The bathing area may not be entered with street shoes. The wearing of safe bathing shoes is mandatory in the bathing area.
(4) The bathing facility may not be visited with infectious diseases.
(5) For reasons of hygiene, a shower must be taken before entering the pool. The showers must be turned off immediately after use. Careful and economical use of water is requested.
(6) The use of soap, shampoos or detergents and the washing of swimwear in swimming and bathing pools is prohibited.
(7) Waste (bottles, glasses, cans, paper, etc.) must be disposed of in the waste garbage cans provided.
2.6 Refraining from hazards and nuisances
(1) Every bather is obliged to show consideration for other bathers, especially with regard to noise. Therefore, everything that disturbs or even endangers other bathers must be avoided.
(2) The boundaries of the bathing area may not be climbed on or over.
(3) All facilities and equipment in the baths may only be used in accordance with their intended purpose (e.g. children's paddling pool, non-swimmers' area, water slides).
(4) The usual rules of decency in public facilities must be observed. Any sexual or intimate acts are not permitted and may be punished with a ban from the premises (without reimbursement of admission fees already paid) and criminal charges.
(5) Photographing and filming people without their express consent is strictly prohibited.
(6) The use of cell phones, tablets and similar devices in the naturist area is prohibited.
2.7 Diving area
(1) Diving is only permitted in pools or parts of pools designated for this purpose and at the times prescribed for this purpose.
(2) Diving operations may be restricted if the number of visitors is high enough.
(3) Jumpers must ensure on their own initiative that other bathers are not endangered.
(4) In the diving area, guests in the water must take special care to ensure that the diving operation does not endanger themselves or other bathers. Swimmers and divers must show consideration for each other.
(5) In diving pools or parts of pools set up exclusively for this purpose, use by other bathers during the diving operation is only permitted to the extent that a smooth diving operation that does not endanger the bathers is possible
2.8 Use of pools, equipment etc.
(1) The equipment and facilities offered in the pool (e.g. water slides) are to be used in accordance with the rules of use.
(2) Users of the equipment and facilities must ensure that other bathers are not endangered. Bathers in the vicinity of equipment and facilities must ensure that users of the equipment and facilities do not endanger themselves or other bathers. Bathers must show consideration for one another; has a special duty of supervision for minors.
(3) The instructions of the staff must be followed at all times.
2.9 Use of additional facilities
(1) Sports equipment, sunshades and other facilities can be borrowed and used according to the tariff list from as long as stocks last.
(2) Each bathing guest may only use one seat or lounger. If this is not used, a longer-term reservation by placing towels, bags, etc. is not permitted - if necessary, these items may be removed by the pool staff.
(3) Compensation must be paid for loss or damage.
2.10. Deposit and loss of objects, parking of vehicles
(1) Valuables must be deposited - if possible - at the bathing ticket office against receipt; no liability is accepted for valuables otherwise brought into the bathing area.
(2) Objects found must be handed in at the pool cash desk against confirmation.
(3) Vehicles or other objects may only be parked in such a way that access to the baths is not obstructed, in particular with regard to rescue, fire department or police operations.
2.11. Duty to report / duty to provide assistance
(1) Accidents, thefts and complaints must be reported immediately to the responsible staff or the management of the bathing facility.
(2) Every bather is obliged to provide the necessary first aid or other assistance.
2.12. Consumption of food, alcohol and beverages
(1) Food and drinks may only be consumed in the designated areas.
(2) The use of glassware is prohibited in the barefoot area.
2.13. Other
(1) Any kind of commercial activity or advertising in the area of the bathing facility requires the consent of the owner.
(2) Smoking is only permitted in the designated areas.
